The BPU of KCK is performing an illegal operation between Board Members of Western Fuels of Denver Colorado and the Executive of the BPU. This corruption affects the price of our utilities and has caused the high Pilot charges on our bills.

These coal contracts that started in 2005 with Western Fuels came on the hills of bankrupting a coalmine owned by the BPU in Illinois. Bankrupted BPU Coal Mine

Contract with Western Fuels and it’s members and Board Personnel are of the take or pay style of contract and only benefit the Coal Company, as I see. Contract stipulations for “Take or Pay” is just that, if you don’t take the coal you pay for the coal. Coal is shipped from Western Fuel in 110 to 150 coal cars owned by BPU. Bought by ratepayers and maintained by the same. Buying coal is not the problem it is how you buy it and who manages the contracts. In this case, coal contract are managed by BPU Executive and General Manager Don Gray and by Darrell Dorsey who is head of Electric Operations for BPU. These two top official of the BPU not only buy the coal but are also on the Board as members of Western Fuel. See Attached Western Fuel Board compared to BPU Executives. Here is the problem that I see and that creates high rates for ratepayers of the BPU.
Energy contracts at the BPU internal operations state that a 45 days supply of coal be on hand or money accessible to buy 45 days of coal if needed for emergency power manufacturing, as summer high heat and air conditioning usage. As of last month the BPU had over 200 days of coal just lying on the ground at the Nierman plant alone and camouflaged by rail cars to street viewers. This is an over cast supply of coal that ratepayers are obligated to pay. While under the Western Fuel contract every week they, under contact of Don Gray, deliver 100 to 150 cars of coal to BPU. Train loads of coal contain 80,000 tons per car and coal prices are $40.00 a ton and they come week after week and so on and rate payers must pay for this excessive contract by higher rates or add-ons to the bill as ERC. ERC rates compared by BPU and Independence, Missouri are as follow:
The City of Independence, that is ran by BPU ex GM Leon Daggett, has an ERC rate of $ ½ cent apposed to our BPU who has a $ 3 cent rate imposed to all KWH used in a month. See link - BPU Rates and BPU web RatePayers Feel the Cost

PILOT Fee’s (Payments in lieu of Taxes) on the BPU bill has risen greatly over the years and we will compare:
Independence is at a steady 9% but the City must pay for all Utilities it uses. Under rules the City is allowed to charge private businesses providing services to or for the City a pilot fee but pays for utilities the City uses.

KCK/UG has a fee of 11.9% while in 1995 under Daggett it was 5.9%. The City of KCK/UG receives for free, all utilities it uses. This might explain why lights are on or windows and doors are open at City Facilities. Our City charges the ratepayers both PILOT and gets free utilities, all without shame, while BPU elected official who were elected to protect the People/Owners/Ratepayers by keeping rates and charges to a minimum allow Pilot and free utilities and corruption to happen. Right now charges on the BPU Bill are 1/3 for utilities, 1/3 for ERC etc at BPU and 1/3 to the City Pilot. Yes! 2/3 of the BPU bill is for other than Utilities.

The City, as always, in a fit of greed tells you during the elections that all is ok, the City is in great shape, no money problems and the BPU and Schools are 110% wonderful. After the election the City is broke and needs tax and utility rate raises and the school tax levy is going up and up. Two months after the City proposes to give away Millions to Billionaire Businesses like Wal-Mart and Schlitterbahn. Link The City is Broke but keeps giving away $ Millions?

Our City under Dennis Hays talks of $15 Million dollar budget shortfall but all the while Topeka reports different sales tax numbers than is used in current City budget.

TJ Reardon who had a Grand Jury Convened last year is getting signatures again to bring another Grand Jury to town. The new petition requesting registered voters signatures is asking for an investigation in illegal operations of the City, BPU, KCKCC and School Districts. If the Public pays mill levies, taxes or rates then the Public should have clear transparency of where the money is spent. The petition requests that every penny be accounted for as to whom, what, where, how, when and why it was spent. Crimes affecting public trusts is the focal point of the petition and alleged violations of Kansas Statutes are Misuse of Public funds, Deceptive Commercial Practices, Official Misconduct, Compensation for past Official Acts, Presenting and Permitting False Claims, Bribery, Racketeering, Gratuities and Kickbacks, Nepotism and Cronyism, Violations of the Real Estate Brokers Act, Illegal Condemnations, Exaggerated Taxes and Appraised Values and Civil and Criminal Conspiracy with partnerships that deceive the public and violations of law affecting KRPC (Kansas Rules of Professional Conduct) and the Kansas Consumer Protection Act.

Next week is the sham at the KCKCC, where student are given the answers to all tests during testing in the GED program that is Grant funded and payment is give for all that pass. Teachers and Students have filed grievances, all have been reprimanded and students kicked out of school.

As I got involved with this I find all kinds of corruption involving the executive staffing and past executives and board members. Millions of $$ going under the table and across the bridge. KCKCC Troubles Grow

Please, bottom line is this – Make the People #1 priority – Remember without $ money from the People/Ratepayers/Taxpayers you have NO BPU, NO City, Schools or College. The Top Ten things that must Change to improve our City
